Please read this Privacy Policy carefully because it governs your use of the Flowtrac Solutions. If you do not agree to this Privacy Policy, do not use the Flowtrac Solutions.

What does this policy cover?

This Privacy Policy describes how Distribution Management Company, Inc. d/b/a Flowtrac (“Flowtrac”, “we”, “us”, “our”) and its affiliates use your information. This Privacy Policy applies to the information collected by Flowtrac both offline and online, including through websites (“Sites”) and online or mobile applications (“Apps”) owned and operated by us and through any interactive features, applications, widgets, blogs, social networks, and any other online or wireless offerings that post a link to this Privacy Policy, whether accessed via computer, mobile device, or other technology (collectively, “Flowtrac Solutions”). This Privacy Policy does not apply to information that we handle as a “processor” or “service provider” on behalf of our customers such as when you or your employer has purchased access rights to or licensed our software applications (“Services”), and you use our Services through your employer. Our processing of such information is governed by our agreements with each customer. We do not control what our customers do with the information we process on their behalf. For information that we process on behalf of a customer, please see the customer’s privacy policy or contact that customer for more information and to exercise any rights with regard to such information.

Please note that when you enter any subsites accessible through Flowtrac Solutions, such subsites may have their own specific privacy policies. Additionally, the websites of affiliated Flowtrac companies (including some that are linked to/from the Flowtrac Solutions and internet domains that are linked to/from the Flowtrac Solutions) may have different policies; therefore, please review the privacy policy notices on those websites if you visit them.

What information do we collect?

Information You Provide.

When you use the Flowtrac Solutions or otherwise interact with us in any medium, you may provide us with information about yourself, such as your first and last name, e-mail address, mailing address, telephone number, and the password you create to use certain Flowtrac Solutions.

Flowtrac Solutions do not require the provision of personal information within the Solutions, other than as may be necessary for account registration; however, to the extent you provide personal information within your or your employer’s use of the Flowtrac Solutions, we act as a processor or service provider of such information and that information is not subject to this Privacy Policy.

Information We Collect Automatically.

When you visit or interact with the Sites, Flowtrac and certain third-party vendors and partners automatically collects certain information about you using cookies, pixels, and similar technologies. These perform a variety of functions, including recognizing your device, remembering your preferences, enabling the Flowtrac Solutions to function, assisting with security, and improving our analytics.

Cookies and similar technologies (collectively, “cookies”) may collect the following information about you:

  • Device information and identifiers: such as your IP address; information about the computer, mobile device, or other device you use to access the Sites, such as device ID, browser type, operating system;
  • Usage information about your use of the Sites, such as the referring website, the page served, the time at which a page was accessed and/or the time spent on a page, and the preceding page views.

We may also collect information about the general location of the device used to access the Sites.

Information From Other Sources.

Flowtrac may receive information about you from other sources. For example, if you are on another website and you opt-in to receive information from us, that website will forward your e-mail address and other information about you to us so that we may contact you as requested. We may also supplement the information we collect about you with outside records from third parties in order to enhance our ability to serve you, to tailor our content to you, and to offer you opportunities to purchase products or services that we believe may be of interest to you.

If you interact with us on social media, such as one of our LinkedIn pages, we may collect information about you such as your reactions to or comments on our posts.

How do we use this information?

We process the information we collect for the following purposes:

  • As required for business purposes or to establish and fulfill a contract with you, for example, fulfilling an online software purchase or product registration. This may include verifying your identity and communicating with you and providing services relevant to our business, including providing customer services and arranging the delivery or other provision of products or services.
  • As required by Flowtrac to enable our business, in particular:
    • to provide services you have requested, and respond to any comments or complaints you may send us;
    • to monitor, improve, and protect the Flowtrac Solutions;
    • to tailor your experience on our Flowtrac Solutions or personalize our services for you;
    • to provide you with support and answer questions or other requests;
    • to communicate with you, including to send you information about products and services that might interest you;
    • to prevent, investigate, and/or report: fraud, misrepresentation, security incidents or crime, in accordance with applicable law;
    • to investigate any complaints received from you or from others, about the Flowtrac Solutions or our products or services;
    • to invite you to take part in market research or surveys;
    • to improve the Flowtrac Solutions and our content and services, for internal business purposes, and to contact you with regard to your use of the Flowtrac Solutions and, in our discretion, changes to any of our policies.
  • For compliance with applicable laws and protection of Flowtrac’s business and legal rights, including, but not limited to, use in connection with legal claims, compliance, regulatory, and investigative purposes (including disclosure of such information in connection with legal process or litigation).
  • For any other lawful purpose with your consent.

How do we disclose this information?

Affiliates: Flowtrac may disclose your information to Flowtrac affiliated entities (“Affiliates”).

Service Providers: We may disclose your information to vendors that we engage to perform certain functions on our behalf, such as providing content; fulfilling your requests; improving our content or services; performing data analysis; sending communications on our behalf, hosting and operating the Flowtrac Solutions, or otherwise performing services for us.

With Your Consent or At Your Direction: We may disclose your information consistent with your consent or direction to do so. For example, we may offer you the opportunity for your information to be provided to third parties so you can receive third-party information and/or marketing offers. Once we provide your information to a third party, we no longer govern how it is used; so if you wish for a third party not to use your information, you much communicate with the relevant third party, not us.

Business Transactions: We may disclose information about you if we participate in a merger, acquisition, bankruptcy proceedings, or other transfer or reorganization of assets, including in contemplation thereof. In such a case, your information may be one of the business assets we transfer, and we may disclose this information to the relevant parties in connection with a business transfer.

Legal Purposes

We may disclose information about you: (i) to comply with legal obligations; (ii) when we believe in good faith that the law requires it; (iii) at the request of governmental authorities conducting an investigation; (iv) to verify or enforce our terms of service or other applicable policies; (v) to respond to an emergency; or (vi) to otherwise protect the rights, property, safety or security of third-parties, visitors to the Flowtrac Solutions, or the public. We may also use Device Identifiers to identify users, and may do so in cooperation with copyright owners, internet service providers, wireless service providers, or law enforcement agencies, at our discretion. Such disclosures may be carried out without notice to you.

Cookies & Similar Technologies

We use cookies and other similar technologies (“cookies”) for various purposes, including to enable certain functionalities of the Flowtrac Solutions and Sites, enhance your experience, analyze and track the use of Sites. We may allow third parties to place cookies on the Flowtrac Solutions for such purposes.

“Do Not Track” Signals. is a privacy preference that is available in certain web browsers which you can learn more about here. We do not currently recognize or respond to browser initiated DNT signals.

Your Rights and Choices

Depending on your jurisdiction and your relationship with us (such as California), you may have the right to make certain requests of us regarding your information, including but not limited to the right to ask us to:

  • Inform you about the categories of information we collect or disclose about you; the categories of sources of such information; the business or commercial purpose for collecting your information; and the categories of other parties to whom we disclose your information.
  • Provide you access to and/or a copy of certain information we hold about you.
  • Correct or update certain information we hold about you.
  • Delete certain information we have about you.
  • If applicable, opt you out of profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.

Certain information may be exempt from your requests under applicable law. In addition, we need certain information to provide the Flowtrac Solutions or for legal or compliance purposes. We may deny your request due to legal exceptions or requirements. As a reminder, if you are an end-user, please contact your entity’s (our customer’s) administrator(s) to exercise any rights and choices you might have.

Security

Flowtrac uses commercially reasonable safeguards to help protect and secure your information. However, no electronic data transmission or storage of information can be guaranteed to be 100% private and secure. You understand that any message or information you send to Flowtrac may be read or intercepted by others. Flowtrac does not ensure or warrant the security of any information you transmit to us, and you use the Flowtrac Solutions and provide us with your information at your own risk.

Please note that we monitor use of the Flowtrac Solutions for security and fraud prevention purposes.

Changes to Privacy Policy

Flowtrac reserves the right to change this Privacy Policy at any time, without prior notice to you unless legally required, and any changes will become effective immediately upon posting. Please review this Privacy Policy periodically for changes. Your continued use of the Flowtrac Solutions indicates your agreement to the updated Privacy Policy, so if you do not agree to any changes we make to this Privacy Policy, please stop using the Flowtrac Solutions.

PRIVACY NOTICE FOR CALIFORNIA RESIDENTS

This Privacy Notice for California Residents supplements the Privacy Policy and applies solely to residents of the State of California (“consumers” or “you”). The California Consumer Privacy Act of 2018 (as amended from time to time, the “CCPA”) requires us to provide California residents with information about the categories of “personal information” (as defined in the CCPA) that we have collected about California consumers, the categories of sources from which the information was collected, the business or commercial purposes (as those terms are defined by applicable law) for which the information was collected, and the categories of parties to whom we disclose personal information.

    We collected the following categories of personal information from consumers within the twelve (12) months prior to the “Last Updated” date of this Privacy Policy.

We collect the foregoing personal information directly from you, automatically through cookies and similar technology, and from third party sources, as outlined in Section __ above.

In the previous twelve months, we have collected and disclosed the above categories of personal information for the business and commercial purposes set forth in Section 3 above.

We may disclose any of the categories of personal information above as set forth in Section 4 of our Privacy Policy above.

  • Your CCPA Rights
    If you are a California resident, you have the right to request that Flowtrac:
    • Provide you the categories of personal information we have collected or disclosed about you; the categories of sources of such information; the business or commercial purpose for collecting, “selling,” or “sharing” your personal information, as those terms are defined by the CCPA; the categories of parties to whom we disclosed, “sold,” or with whom we “shared” personal information; and the categories of personal information we “sold” or “shared.”
    • Provide access to and/or a copy of certain information we hold about you.
    • Delete certain personal information that we hold about you.
    • Correct inaccurate personal information that we hold about you.

You may have the right to receive information about the financial incentives that we offer to you, if any. You also have the right to not be discriminated against, as provided for in applicable law, for exercising certain rights. Certain information may be exempt from your requests under applicable law. In addition, we need certain information to provide the Services or for legal or compliance purposes. We may deny your request due to legal exceptions or requirements.

We may take steps to verify your identity. If an authorized agent or entity makes a request on your behalf, we will still need to verify your identity and may request written confirmation that the agent is authorized to make a request on your behalf.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response electronically.

Right to opt out of “sale” and “sharing” of “personal information”

Under the CCPA, our use of certain analytics and advertising cookies and similar technologies may be considered to involve a “sale” or “sharing” (i.e., use for targeted advertising) of “personal information,” as such terms are defined under the CCPA. Depending on what Sites and/or Services you use, we may “sell” or “share” the following “personal information”: Contact information, cookies, IP address, and/or browsing behavior and information about your potential interests or characteristics.

We do not sell or share personal information.

Retention

We keep your information as long as we determine it is necessary to fulfill the purposes described above, unless a longer retention is required or permitted by law. Our retention is based upon the amount, nature and sensitivity of the information, our purposes for which we process the information, applicable legal requirements, and our legitimate interests. The different purposes for which we process information may result in different retention periods for the same types of information.

“Shine the Light” Disclosure

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We do not disclose personal information to third parties for their direct marketing purposes.
